Notes

Our service is suitable:

  • If you want to see a copy of the Will.
  • If you want to know when a Grant of Probate was issued.
  • If you want to make a claim against the estate and need a copy of the Will, and know if Grant of Probate has been issued.
  • The deceased must have been a resident of England and Wales, and died after 1996.

What to Expect:

  • Your application will be processed and submitted within 48hours of payment.
  • If a Will or Grant is available you will receive a digital copy by email within 14 working days.
  • If not and appropriate a Standing Search will be performed.
    • In this event you will receive an email as soon as the standing search is entered and / or a letter of acknowledgment within 25-30 working days of application, confirming the Standing Search.

What will I receive?

  • If a Will has been issued and it is available immediately you will receive a digital copy of the Will by email within 14 working days
    • If no Will is immediately available we will perform a Standing Search on your behalf.
  • If a standing search is entered one of 3 things will occur:
    • you will be sent a copy of the Will and a copy of the Grant of Probate, by post or email if issued within the 6 months of the search.
    • you will receive a copy of the Grant of Probate only. e.g. when someone dies intestate (without making a Will).
    • you will receive neither a Will nor Grant of Probate (neither a will nor Grant of Probate was issued), in this case we will contact you to see if you'd like to extend the search.

Why does it take up to 6 months for a standing search?

  • If no Will is available immediately and we cannot supply within 14days then we will perform a standing search (if appropriate) on your behalf.
  • The timescale of a standing search is set by the probate office and we cannot speed up this process.
  • A standing search runs for 6 months.
  • Could this affect me contesting a Will?

    • Without knowing what is in the Will it is not possible to contest. You could try speaking to the executors or perhaps another family member to try to get a copy of the will sooner.
    • You have 6 months from grant of probate within which to contest a will under the Inheritance Act 1975.
    • If you cannot get a copy of the will and you are in doubt of the wills validity / or are close to the 6 months deadline you could consider lodging a caveat with the probate registry, this prevents the estate being distributed.
    • You may be able to get a copy of the will sooner by visiting the probate office directly.
